Privacy Policy
How ArtScan collects, uses, discloses, and protects your information.
Effective date: August 23, 2026
Last updated: October 11, 2026
1. About This Policy
ArtScan AI LLC (“ArtScan,” “we,” “us,” or “our”) operates the ArtScan application, website, cloud features, and related services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the Services.
2. Information We Collect
Depending on the features you use, we may collect the following information:
Account information. When you create an account, we may receive your name, email address, account identifier, and sign-in information from the sign-in method you select. We do not receive or store the password for your third-party sign-in account.
Photos and content. We may process photos and other content you capture, select, import, save, or ask ArtScan to analyze. This can include artwork images, labels, collection information, notes, recognition results, and associated file metadata. Granting camera or photo-library access does not mean every photo on your device is uploaded; ArtScan processes content you select or authorize the app to use.
Please do not submit photographs containing people, identification documents, financial information, health information, or other sensitive personal information.
Location. With your permission, ArtScan may use location information to provide location-related features, such as identifying nearby places, organizing artwork by location, or providing reminders you choose to enable. You can change location permission at any time through your device settings.
Purchases. If you start a trial or purchase a subscription, we may receive information about the product, subscription status, transaction, renewal, cancellation, and eligibility. Payments are handled by the Apple App Store on iOS or Google Play on Android. ArtScan does not receive your complete payment-card information.
Device and usage information. We may collect app version, device type, language, identifiers, feature interactions, performance, errors, crash information, and security-related activity. This information may be associated with a device, installation, subscription, or ArtScan account.
Communications. When you contact us, we may collect your contact information, message, attachments, and information needed to respond.
3. How We Use Information
We use information to:
- Provide and maintain the Services
- Create and secure accounts
- Analyze and organize artwork
- Save, synchronize, back up, and restore content
- Provide location-related features
- Manage trials, subscriptions, and access
- Respond to support requests
- Detect fraud, misuse, and security threats
- Diagnose technical problems and improve the Services
- Measure the effectiveness of promotions
- Comply with legal obligations and protect ArtScan, our users, and others
We use scan activity and artwork information to provide public discovery features and aggregated rankings, without displaying users’ photos, identities or individual scan histories.
We may use aggregated or de-identified information for analytics, research, and service improvement when it cannot reasonably be used to identify an individual.
4. AI-Assisted Processing
ArtScan uses automated and AI-assisted technologies to provide artwork identification and related features. When you choose to analyze content, you request that ArtScan send the selected content and relevant context to third-party AI and data-processing service providers that help process the request and return results.
We may use text extracted from artwork labels with third-party AI providers to develop educational content.
We limit the information sent to what is reasonably necessary for the requested feature. Processing and retention by these providers are subject to applicable agreements, settings, security requirements, and law. You should not submit content containing people, identification documents, financial information, health information, or other sensitive personal information.
ArtScan’s results may be incomplete or incorrect and should not be treated as professional authentication, appraisal, valuation, or ownership advice.
5. Cloud Features
Some ArtScan information is stored locally on your device. When you use ArtScan's cloud features, account information and selected content may also be stored through cloud service providers.
Cloud storage allows ArtScan to back up, synchronize, and restore your library. Stored content may include photos, artwork information, collections, organization, and related metadata. Content stored locally on your device is controlled separately from cloud content.
6. How We Disclose Information
Service providers. We use providers that support hosting, storage, authentication, content processing, subscriptions, analytics, diagnostics, security, communications, and customer support. They may process information to provide their services, maintain security, comply with law, and perform other authorized functions. We require service providers that process personal information on our behalf to protect it consistently with this Privacy Policy and applicable law and to use it only for authorized purposes.
At your direction. We may disclose information when you request a feature, choose to share content, connect another service, or otherwise direct us to do so.
Legal and safety purposes. We may disclose information when reasonably necessary to comply with law, respond to lawful requests, prevent fraud or abuse, protect safety, enforce our agreements, or defend legal claims.
Business transactions. Information may be disclosed as part of a merger, financing, acquisition, reorganization, or sale of all or part of ArtScan, subject to appropriate protections.
Public features. Content you intentionally publish through a public or community feature may be visible to other users or the public.
7. Analytics and Advertising Measurement
We may use limited device and interaction information to understand use of the Services, maintain performance, and measure promotional campaigns. ArtScan does not sell personal information in exchange for money, and we do not use the contents of your private artwork library to create an advertising profile.
Some disclosures for advertising measurement may be treated as "sharing" or "targeted advertising" under certain privacy laws. Where required, we request permission before enabling this processing and provide applicable choices. You can control device-level tracking permission through your device settings or contact us to exercise an applicable opt-out right.
8. Retention
We retain information for as long as reasonably necessary to provide the Services, maintain security, comply with legal obligations, resolve disputes, and enforce our agreements. Account information is generally retained while the account remains active.
If paid or trial access expires, cloud content may remain available for recovery for up to 180 days. If access is not restored during that period, the cloud content is scheduled for deletion. Content stored locally on your device is not affected.
Temporary processing information is retained only as reasonably necessary to complete a request, handle failures, prevent abuse, and maintain reliability. Limited records may be retained after deletion for security, fraud prevention, legal compliance, dispute resolution, or to keep deleted information from being improperly restored. Residual copies may remain temporarily in backups or delayed-cleanup systems before removal through normal deletion cycles.
9. Account Deletion
You may initiate account deletion in the app by going to Settings → Account → Delete Account. If you cannot use the in-app process, follow our account deletion instructions or contact support@artscan.app.
Account deletion generally removes your ArtScan account and associated cloud content. Some deletion steps may continue in the background and require additional time. Deleting your ArtScan account:
- Does not automatically remove artwork stored locally on your device
- Does not remove photos from your device's photo library
- Does not automatically cancel an active App Store or Google Play subscription
- Does not require deletion of information we must retain by law
You must separately cancel an active subscription through the store where you purchased it: the App Store or Google Play. Signing out is not the same as deleting your account.
10. Your Choices and Rights
Depending on where you live, you may have rights to:
- Access personal information
- Correct inaccurate information
- Request deletion
- Receive a portable copy of certain information
- Withdraw consent
- Object to or restrict certain processing
- Opt out of certain advertising or data sharing
- Appeal a decision concerning a privacy request
- Submit a complaint to a privacy authority
You can also control camera, photo, location, notification, and tracking permissions through your device settings. To submit a privacy request, contact support@artscan.app. We may need to verify your identity before completing a request. We will not unlawfully discriminate against you for exercising a privacy right.
11. Legal Bases for Processing
Where applicable law requires a legal basis, we process information as necessary to provide the Services and fulfill our agreement with you, with your consent, for our legitimate interests in operating, securing, and improving the Services, and to comply with legal obligations. You may withdraw consent at any time without affecting processing that occurred before withdrawal.
12. International Processing
ArtScan and its service providers may process information in countries other than the country where you live. Where required, we use legally recognized measures designed to protect information transferred internationally.
13. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information. However, no electronic transmission or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for protecting access to your device and sign-in account.
14. Children
ArtScan is not directed to children under 13 or the higher minimum age required by local law. We do not knowingly collect personal information from children below the applicable minimum age. If you believe a child has provided personal information without appropriate authorization, contact support@artscan.app.
15. Changes to This Policy
We may update this Privacy Policy as our Services, practices, or legal obligations change. We will update the date at the top of this policy when changes are made. If a change materially affects how personal information is used, we will provide additional notice or request consent where required.
